23rd july 2011-City Limouzine

Kaiser Baig was arrested by EOW unit 3 yesterday and Manoj Vighe was arrested by Nagapada Police Station 2 days ago. Warrants have been issued for Seema, Geeta and Umar Razzaki as well.

 the case was posted for two weeks on 11/7/2011. I can not say sure
whether it will come on 25/7/2011, may come may not come.
Another question Masood has sufficient means of money plenty of money
he has. Sunday that is 17/7/2011 also he was in in EOW up to 0800 PM
and yesterday also 0730 PM dated 21/7/2011 also he was in EOW. He has
no scarcity of money, Money is not a problem for him. neither he wants
 to solve the problem.
He filed cases for quashing all criminal proceedings against him and
the F.I.Rs in Supreme Court and to convert them to civil cases.

UNKEPT PROMISES - 11 jun 2011

  • It is alleged that Masood has cheated around 64 investors to the tune of Rs73 lakh by making false promises of giving them high returns on their investment
  • The victim had invested in Combo-Offer in Masood’s company wherein they were assured returns on car-rental and plot-rental scheme 
  • The officers said that the investors from Chennai, Hyderabad, Delhi, Rajasthan and Bangalore were also
    duped as they too had invested their hard-earned money in Masood’s company
  • Masood was held in Bangalore on Friday and was brought to the city on Saturday. He is presently under
    police custody till July 15, said the police.

If MP invenstment fraud by PCL Ltd and other 33 companies are being covered by news channels then why CITY group is not on channels.
 
Please do some thikng to bring it out in public thru new channels.

As advised, let the investors file the claim for City Limouzines.  What about the amount invested in City  Co-op.  Society.  One has to remember one thing that even though there are different receipts( City Limouzines, Citi Realcom and City C0-Op. Society) given by the Company but the monthly cheques given were of City Limouzines only.  Therefore some of us have filed claims including all the above companies/society as the Company is one.  Kindly seek necessary advise in this matter and clarify.  Further, we in Karnataka some of us have filed the claims on a non-judicial stamp paper of Rs.20/- duly notarised as there are no court fee stamps available in Karnataka.  Please advise and thank you very much for the above information.

The Official Liquidator is appointed for City Limouzines only at the
moment.You have to file your claim only for City Limouzines and only
the receipts issued by City Limouzines and payments received from City
limouzines are to be taken into consideration.

When the Liquidators are appointed for City Realcom and City Co-
operative Society, then we will have to file claims with them
separately. Although you have made payments to City Realcom and City
Co-operative Society, but you have not received anything from them. So
you will have to claim accordingly.

According to my information, you cannot club all companies of City
group to lodge your claim with liquidator appointed for City
Limouzines only. However, some of Mumbai based investors can go to the
Liquidators office in Mumbai and get clarifications on all the points
which are being raised by the investors on this forum.

Mr. Z.A. Khan from Chennai has confirmed that either Non-Judicial
stamp paper of Rs. 20/- or court fee stamp of Rs. 5/- is acceptable.
More clarification from Mumbai Liquidators Office.

May I request one of the knowledgeable investors from Mumbai to go to
the Liquidators Office to seek clarifications on various points which
are being raised on this forum and post the same here for the benefit
of the investors.

Dear Investors,
As promised in my last mail earlier this week, I am sending all the details for filing your claims.
PROCEDURE TO BE FOLLOWED FOR FILING OUR CALIM WITH LIQUIDATOR.
(This procedure is also given in the attachment to my mail)
Since the Liquidator has been appointed only for City Limouzines (India) Ltd., we can only file our Claim in respect of City Limouzines (India) Ltd. to the Liquidator so appointed by the Bombay High Court for legally winding up City Limouzines (India) Ltd. affairs.
Only one claim per individual, irrespective of the number of cases (of investments) may be filed. So a consolidated Claim for all the investments in City Limouzines (India) Ltd. needs to be made, officially in the prescribed Format to the Liquidator appointed by Court, to qualify for any final settlement in favour of the investors by the Court. Please note if no Claim is lodged with the Official Liquidator then no share of such investor in the final outcome of the settlement/official winding up of the Co., will be entertained later since such investor will not be considered an official creditor of City Limouzines (India) Ltd.

I will take the example of a Combo Scheme case and explain the procedure, as below:
A.       FOR FILING CLAIM IN RESPECT OF CITY LIMOUZINES (INDIA) LTD.
     1.    You have been issued 3 Receipts in respect of the Combo Scheme.  1st receipt is from City Limouzines (India) Ltd., 2nd Receipt is from City Realcom Ltd. and the 3rd Receipt is from City Co-Op. Credit Society. Take the value of City limousines (India) Ltd. receipt only for filing claim with City Limousines (India) Ltd.
     2.   Fill in the file No. in column ”A” of Exhibit - A forming part of Form No. 66.
     3.    Fill in the City Limouzines (India) Ltd. receipt amount in column ”B”.
     4.    Fill in the receipt number in column “C”.
5.  Take your copy of the Agreement on Stamp Paper of City Limouzines (India) Ltd. If it says for eg., a sum of Rs. 6,250/- will be paid every month for 5 years (60 months), this means that the amount to be paid, as per the Stamp Paper Agreement, is Rs. 3,75,00/- (6,250X60=3,75,000). Fill this amount in column ”D”.
6.   Consider only payments received by you from City Limousines (India) Ltd. account using City Limouzines (India) Ltd. cheque book.
7.  Take a total of all the cheques received from City Limouzines (India) Ltd. account using City Limouzines (India) Ltd. cheque book. That is the amount paid by City Limouzines (India) Ltd. to us. Fill this amount in column ”E”.
8.  Add amounts in column “B” & column “D” and subtract the amount from column “E” and fill the result in column “F”.
9.  Original Form 66 should have a court fee stamp of Rs. 5/- affixed on the top and the Form needs to be notarized. I understand that Mumbai Liquidator is accepting Form 66 only on green coloured paper. Don’t forget to attach Exhibit – A forming part of Form No. 66.
10.  Attach photocopies of all City Limouzines (India) Ltd. receipts entered by you in column “C” of Exhibit-A which forms part of attachment with Form no. 66.
11. Form No. 66 (partly filled) with Exhibit-A is attached with this mail. In case you cannot see the attachment here, please go to the following link and follow the steps. You will be directed to a page where you can see and download all the attachments.
11.  Address a letter to the Liquidator enclosing the original as well as photocopy of Form 66 and Exhibit-A. (Draft of covering letter attached) requesting the Liquidator to return the photocopy of Form 66 together with Exhibit - A as proof of receipt. Please enclose a stamped self-addressed envelope for this purpose.
12.  You can follow similar procedure for other schemes of City Limousines (India) Ltd. However, this should be done only when the Official Liquidator is appointed by the Court.

REQUEST: May I request some of the investors to go to the Liquidators office in Mumbai and clarify the following points.
  1. Would the Liquidator’s office accept Form No. 66 only on green coloured paper (as intimated to one of the investors from Delhi earlier) or they would accept the same on plain white legal size paper as well?
  2. Would they accept the mail sent to them by registered post/speed post/courier or by ordinary post/ordinary post under proof of posting?
  3. Confirm whether the phone nos. of Official Liquidator’s office are correct.
  4. Any other remarks or suggestions from Official Liquidator’s office regarding form No. 66 and its attachment.
Other enlightened investors may also offer their valuable suggestions for the benefit of all the investors.
I suggest that the investors could wait for the above clarifications before taking any action.

accountant of the City Limo office ( PUNE ) was arrested. The total
arrest goes to no 18. He is now in police custody & he was the
accountant & knowing the companies business very well., We are waiting
& fighting for our funds. But similarly it is very important that all
other persons who were participated in company to cheat us should get
punished.

Investigations into the multi-crore City Limouzine scam have revealed that chairman of the group, Sayed Masood, was planning to get into the aviation sector. The police believe this could have been yet another move to attract people to invest more money. Masood had given money to an aviation firm to purchase a plane, but the deal fell through, they said.
“Masood was planning to start his own airline. He had paid Rs1.40 crore to a Kolkata-based company to purchase a plane worth Rs3 crore,” said an Economic Offences Wing (EOW) officer, requesting anonymity.
The officer added that the deal was made in 2007 and Masood had got the required permit from the civil aviation ministry. “Since the permit had expired and Masood did not renew it, the deal got cancelled. His company’s website shows that he registered a company named City Airlines,” said the officer.
However, the police believe that getting into the aviation sector was not Masood’s real motive. “The plane he wanted to buy was small. We believe that he wanted to show investors that he had purchased a plane and would require money to set up an airline business. He would have floated another investment scheme,” the officer added.
Initially Masood started City Limouzine and people started investing money. Then he floated City Realcom (a real estate company). “With an entry in the aviation sector, he could have made more money. But the plan failed as he could not get his permit renewed,” said the officer.

The Economic Offences Wing (EOW) the of city police on Saturday arrested Sayyed Masood, director of City Limouzine Group, in a fresh case of cheating.
It is alleged that Masood has cheated around 64 investors to the tune of Rs73 lakh by making false promises of giving them high returns on their investment. The victims had invested in Combo-Offer in Masood’s company wherein they were assured returns on car-rental and plot-rental scheme.
Masood was apprehended in Bangalore on Friday and was brought to the city on Saturday. He is presently in police custody till July 15, said the police.
According to EOW sources, complainant Kalpesh Rajnikant Pise had read an advertisement in a newspaper about Combo-Offer of City Limouzine some time back wherein the company had promised huge returns on investment.
“The company had promised that they would purchase cars from the money invested by the investors and would rent them. The rent amount would have given to the investors. Another offer was that the investors will purchase some plot of the company which would again be given on rent and the amount would be given to the investors,” said an EOW officer.
He added that Pise fell pray to this lucrative offer and invested Rs3.5 lakh.
“Like Pise, 63 other investors had also invested around Rs73 lakh in the company. The company initially made some payments, but defaulted later since their cheques bounced. After the company locked its shutters in 2009, Pise lodged a complaint against him,” the officer said.
The officer also said that the investors from Chennai, Hyderabad, Delhi, Rajasthan and Bangalore were also duped as they too had invested their hard-earned money in Masood’s company.
“Investigation is in progress and we are ascertaining where Masood has invested victims’ money and whether he had purchased any property through this ill-gotten money,” the officer added. - DNA

    Two City Group firms — City Limouzine and City Realcom — had promised lucrative returns on investments through various schemes. In 2002, the group issued advertisements of the schemes in newspapers. In September 2007, the first complaint was registered against the company after it defaulted on returns. Soon, cheques issued to several other investors too
bounced, causing panic.

    ED and economic offences wing of the city police are investigating the comp l a i n t s
against the company. While ED is investigating the company for money laundering under the Prevention of Money Laundering Act (PMLA), the economic offences wing (EOW) is investigating the cheating aspect. An ED official said, “Investigations are on to find out the amount he has taken out of the country illegally. We believe it will add up to a few crores.”
City Limouzine offered 48% returns on investments for five years as well as a car at the end of the term. The company said cars would be purchased from the money collected from investors and profits earned by giving it on hire through a trust.
Realcom’s scheme was also on similar lines. On an investment of Rs 1.39 lakh, the company offered Rs 7,775 for five years and Rs 50,000 at the end of it.
Complaints of default were registered across the
country. Masood was arrested in late 2009 and is still in jail. The police had arrested four other senior officials in early 2010 and the courts released them on bail.
    ED has attached around 30 properties valued at more than Rs 100 crore and another Rs 64 crore cash under PMLA.
    The Act allows the agency to seize properties purchased using tainted money. “It is called ‘proceeds of crime’ under the Act. The government will take over the properties and then it’s for the courts to decide on auctioning it and distribute the money received to investors,” an ED official said.

    ED officials said PMLA will act as an effective deterrent against such fly-bynight companies. An official said they would gather details of such other cases from the police and initiate action under PMLA. Investors said they hope that the court would allow the proceeds to be distributed among them.

Court pulls up cops for failing to arrest 4 accused in scam

Mumbai: The heat was turned on against the Mumbai police after the Bombay High Court on Wednesday ticked it off for failing to arrest four accused in the City Limouzine scam, saying they are untraceable.

A division bench of Justice Ranjana Desai and Justice R V More was hearing a clutch of petitions filed by investors who were allegedly cheated and who expressed their unhappiness with the police’s explanation for not apprehending the accused. Cheques issued by the company towards returns on investments bounced since August 2009 affecting thousands of investors across the country. “We refuse to believe you cannot arrest them. If Bombay police wants to arrest someone, it can,’’ said Justice Desai. The judges said the city police is considered the most competent police force in the country. “If you want, you can do it in one day,’’ added Justice Desai.

An affidavit was submitted to the court in which it was pointed out that of the
13 accused, one Masood Jamdar is in jail, four are untraceable, the statements of four others have been recorded and they have been made witnesses in the case while the remaining four were arrested and released on bail last year. “We are unhappy with your affidavit. Why have you not moved the lower courts for cancellation of their bail?” asked Justice Desai. “The matter involves hard-earned money of investors. Life savings have gone. The police must show urgency, sympathy and take quick steps.’’ Advocate Mubin Solkar, appearing for investors, told the court, “It is difficult to digest that the accused cannot be arrested.” He said the police can always attach their properties and issue proclamation.

The judges said the police can resort to taking various legal steps in bring the accused around. “You can build pressure on these accused. In the interest of thousands of people, do some good,” she added. The judges directed the police to state at the next hearing what efforts have been taken by them to trace the four absconding accused. The court has also directed that the record be placed before the court.

The Citi Limouzines India Ltd and its sister companies floated by Mr.S.M.Masood had branches in all most every major city in India.  These companies duped several lakhs of investors all over india by giving 48% of interest in the initial stage.  Several lakhs of investors all over india invested in these companies having got lured due to high returns.  Indeed some of them did get good returns but many of the investors have lost their hard earned money and now came on to streets as they have lost every thing by greed.  Many families are ruined.  Many have invested by taking loans on low interest and invested in these companies thus landed in great trouble.  The post dated cheques issued from this company started bouncing from July 2009  and subsequently the company closed all its officies all over india.  With sincere and honest efforts of some of the investors and by the police the culprit Mr. Masood and his associates were caught and they are presently facing trial as government guests.  Poor Investors are struggling for their living all over India.  In spite of several requests from the invetors to the government, it has not felt the necessity to interevene into this fraud and do some justice to the investors.
 
It is understood that EOW and Bombay police are still investigating the matter.  Meanwhile it is also understood that due to several cases filed against the companies all over india and also in Bombay High Court, the court has decided to liquidate the assests of the companies and do the process of repaying the money to the investors to the extent possible.  In the process an official Liquidator was appointed by Mumbai high court and he is supposed to issue notice to all the investors through the High courts web site for lodging claim.  We the investors are hearing  this from quite some time but nothing is forthcoming since more than 6 months.
 
Mean while I have received a letter under reference from your office where in you have advised me to approach official Liquidator at Mumbai.  The email id provided  for correspondence in your letter is not correct.  However some how I could find out your mail id after a great deal of efforts.  I am a senior Citizen retired from Government of India and presently in too much of  trouble due to the fact that I have gradually have with drawn all my retirement benefits, put into this company and lost every thing.  In my entire family as many as 6 Senior citizens including my mother, sisters also lost all our money.  We are looking at the bleak hope of realizing our money through this liquidation proces which may take more time than our death.
 
Some of the invetors have already made their claim even without the notice of the Official liquidator.  In the bargain some of the investors have lost more money.  I along with my friends and relatives are anxiously waiting for the Notice of the official Liquidator. 
 
Since I do not have that kind of money and energy  to run around in mumbai to find the details, may I request you to kindly show some mercy on all of us by taking some extra trouble if not on your official capacity at least in your personal capacity to find details on this matter and appraise the status through a return mail so that many of us will not only be gratefull to you but alo certainly send our good wishes which will not go as waste in your life.  You can at least have the satisfaction that you could help many people in distress.  You may kindly let us know the email id of the Official liquidator so as to enable us to keep direct touch with him if not any thing better.  May God  Bless you. Somebody is charging for each file Rs. 300/- to 400/- for lodging the complaint. We have already given money to him for 4 files and we were asked to pay another sum of Rs.200/- per file for moving the case. Not sure, if the money has to be given and be trusted. As per sir, money should not be paid to anyone for complaint lodging.. Whereas, we are worried if this will be another City Limo scam to get back individual money. Please advise.

recd. the letter from Registrar Of Co.s(ROC) to approach Official Liquidator

I hv recd. the letter from Registrar Of Co.s(ROC)  to approach Official Liquidator and also a slip of paper attached with it, which says 'In case if you have any grievances regarding CITY GROUP please specify the name of the company, so that this office can take up the matter with the company for resolving your complaint. - (A.B.Athavale),Dy.Registrrar of Cos., Maharashtra, Mumbai.'.  
 
I will shurely send a separate reply to ROC with the details of City realcom and City Credit Socity, Baba Saheb Ambedkar Pratishthan etc.   I believe, all the other members also may have recd, this instruction?
